ANNEXE 2 : ENTENTE GÉNÉRALE ENTRE LE MINISTÈRE DE LA SANTÉ ET LES AGENCES OEUVRANT DANS LE SECTEUR DE LA SANTÉ

General Memorandum of Understanding

This umbrella agreement does not replace the official NGO registration system of the Ministry of Planning and is not related to any specific project proposal which requires formal, separate approval of the Ministry of Health. Its purpose is to outline major principles to be followed by all agencies delivering health care in Afghanistan and needs only to be signed by each agency once every two years.

The agreement obliges both parties to respect the following principles:

  1. Before presenting a project proposal to a donor, the agency will complete the Project Summary Information Form and obtain formal written approval by the External Coordination Department, MoH in Kabul.

  2. Agency will deliver all major components outlined in the Basic Package of Health Services unless they have specific permission from MoH in Kabul to deliver only certain components or to focus on a vertical program.

  3. Agency will follow all health policies of the MoH.

  4. Agency will comply in reporting data and information based on MoH HMIS and standards.

  5. Agency will participate in coordination mechanisms at the central and provincial levels.

  6. Project information including staffing, salary scale and budgets will be made available to MoH in a timely manner upon request.

  7. Agency will agree to participate in the national monitoring and evaluation system operated by MOH and a third party once the system is in place.

  8. Agency staff will conduct themselves and implement their projects in a manner that is culturally-sensitive

  9. Agency will keep number of the expatriate staff to the minimum required; based on needs and competency.

  10. Agency will contribute towards training relevant Afghan staff based on a training need assessment for future sustainability.

  11. The MOH has the right to monitor & evaluate the agencies project activities at any time during the duration of the general MOU.

  12. MoH and agency will respect the principles of equity, efficiency and non-discrimination on the basis of ethnicity, gender or any other factor outlined in the national development budget narrative and interim health strategy.

  13. In addition, under-served areas should be prioritized for service delivery even if these areas present more difficulties logistically.

  14. MoH and agency agree to work together in a collaborative and transparent partnership that is characterized by mutual respect.

  15. Any disputes will be resolved through discussion with provincial MoH or central MoH representatives. MoH reserves the right to appoint a third party to assist in resolving any disputes.

  16. The MoH has the right to terminate this MOU at any time for non-compliance with any of the above provisions of this MOU.
